On Thursday, 6 March 1684 Nevison was finally caught at an alehouse near Sandal Magna, south-east of Wakefield, when he was ambushed by Captain William Hardcastle. It is likely that the fugitive was taken while asleep.

The location of the arrest was an old roadside inn called the Magpie. This inn, which afterwards became the Three Houses, stood beside the Barnsley road near Castle Terrace. It was later pulled down, to be replaced by a new Three Houses on the opposite side of the road. The captain had earlier perceived Nevison at a village called South Milford, while riding to Wakefield and after that had followed him. It is possible that Hardcastle, a local constable who lived at Milnthorpe, was aided in his initial discovery of Nevison by an informer who sent him a letter saying, ‘Sir, the bird is in the cage.’

After his apprehension, Nevison was lodged in York Castle; following his trial for robbery he was sentenced to death. He was executed at the Tyburn gallows outside Micklegate Bar on 4 May 1684 (although dates conflict), aged about 43. He is said to have confessed to Fletcher’s killing, claiming it was an act of self-defence, while resolutely refusing to incriminate any of his criminal accomplices. The parish registers of St Mary’s Church, Castlegate, imply he may have been interred at that place in an unmarked grave.
